Is your phone being blown up by debt collectors?

The Telephone Consumer Protection Act is a piece of legislation that packs a tremendous punch! In reality, debt collectors and others who make unsolicited phone calls to you can be forced  to pay anywhere from $500 to $1,500 per call.

This is how the Telephone Consumer Protection Act works:

  • Cell phones – It is illegal for a third party to call your cell phone without your authorization using automatic dialing technology.
  • Land lines – It is prohibited for a third party to call your landline and leave a prerecorded voice or message without your authorization.
  • Fax machines – Faxes sent to you without your permission are illegal under the Telephone Consumer Protection Act (TCPA).

The Federal Communications Commission issued an Order in 2015 that favored customers’ TCPA rights. The Federal Communications Commission (FCC) mandated that:

Even if a customer previously agreed to be contacted on his or her mobile phone, he or she now has the ability to rescind that agreement.

The Telephone Consumer Protection Act (TCPA) applies to text messages.

TCPA violations apply to calls to consumers who have had their phone numbers reassigned. Do you have a new phone with a recycled phone number, for example? If a debt collector attempts to contact the previous owner of that phone number but instead contacts you, he has broken the Telephone Consumer Protection Act (TCPA). (There is an exemption to this rule for one call to allow the caller the opportunity to not call you again.)
